Αυτήν την σύμβαση (EFSF) θα την υπογράψετε κ. Βουλευτές ;

Η νέα δανειακή σύμβαση δεν θα έχει τη μορφή της πρώτης σύμβασης ,καθώς «ο διακανονισμός γίνεται μέσω EFSF»
Την σύμβαση EFSF όμως την έχει ήδη υπογράψει ο Παπακωνσταντίνου από 7/6/2010.

Ας δούμε όμως....
δυο επίμαχες παραγράφους (15 και 16) του EFSF.

15. MISCELLANEOUS

(1) If any one or more of the provisions contained in this Agreement should be or become fully or in part invalid, illegal or unenforceable in any respect under any applicable law, the validity, legality and enforceability of the remaining provisions contained in this Agreement shall not be affected or impaired thereby. Provisions which are fully or in part invalid, illegal or unenforceable shall be interpreted and thus implemented according to the spirit and purpose of this Agreement.

(2) The Preamble to this Agreement forms an integral part of this Agreement.

(3)Each of the Parties hereby irrevocably and unconditionally waives all immunity to which it is or may become entitled, in respect of itself or its assets or revenues, from legal proceedings in relation to this Agreement including, without limitation, immunity from suit, judgment or other order, from attachment, arrest, detention or injunction prior to judgment, and from any form of execution and enforcement against it, its assets or revenues after judgment to the extent not prohibited by mandatory law.

Κάθε ένα από τα συμβαλλόμενα μέρη με την παρούσα ο αμετάκλητα και άνευ όρων παραιτείται από κάθε ασυλία που έχει ή πρόκειται να αποκτήσει, όσον αφορά τον ίδιο ή τα περιουσιακά του στοιχεία, από νομικές διαδικασίες σε σχέση με την παρούσα Σύμβαση, περιλαμβανομένων, χωρίς περιορισμούς, της ασυλίας όσον αφορά την άσκηση αγωγής, δικαστική απόφαση ή άλλη διαταγή, κατάσχεση, αναστολή εκτέλεσης δικαστικής απόφασης ή προσωρινή διαταγή, και όσον αφορά την εκτέλεση και επιβολή κατά των περιουσιακών στοιχείων του στο βαθμό που δεν το απαγορεύει αναγκαστικός νόμος.

Σας θυμίζει τίποτα η πιο πάνω απίστευτη παράγραφος-δέσμευση ;

Eίναι ακριβώς ίδια, πιστή αντιγραφή αντίστοιχης παραγράφου της δανειακής σύμβασης !!!

16.GOVERNING LAW AND JURISDICTION

(1) This Agreement and any non-contractual obligations arising out of or in connection with it shall be governed by and shall be construed in accordance with English law.

(2) Any dispute arising from or in the context of this Agreement shall be settled amicably. In the absence of such amicable agreement, the euro-area Member States agree that to the extent it constitutes a dispute between them only, it shall be submitted to the exclusive jurisdiction of the Court of Justice of the European Union. To the extent there is a dispute between one or more euroarea Member States and EFSF, the Parties agree
